HR 418 places Homeland Security above lawCall on your Reps to vote on on HR 418



HR 418, the "Real ID" act authored by James Sensenbrenner, literally places the Dept of Homeland Security above the law. Here is the language of section 102: ********* SEC. 102. WAIVER OF LAWS NECESSARY FOR IMPROVEMENT OF BARRIERS AT BORDERS. Section 102(c) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1103 note) is amended to read as follows: `(c) Waiver- `(1) IN GENERAL- Notwithstanding any other provision of law, the Secretary of Homeland Security shall have the authority to waive, and shall waive, all laws such Secretary, in such Secretary's sole discretion, determines necessary to ensure expeditious construction of the barriers and roads under this section. `(2) NO JUDICIAL REVIEW- Notwithstanding any other provision of law (statutory or nonstatutory), no court shall have jurisdiction-- `(A) to hear any cause or claim arising from any action undertaken, or any decision made, by the Secretary of Homeland Security pursuant to paragraph (1); or `(B) to order compensatory, declaratory, injunctive, equitable, or any other relief for damage alleged to arise from any such action or decision.'. ***************** Do we really want to provide fascist powers to the Federal government, placing them above the will of the people they are supposed to be serving? It is clear and obvious that Republicans are using the 9-11 attacks as an American version of Germany's 1933 Reichstag fire, which was Hitler's pretext for the Enabling Act which gave him sole power. Bush and his cronies have used 9-11 (for which they had numerous advance warnings) as an excuse for the Patriot Act and power grabs such as HR418, which are gutting civil liberties and placing ordinary American citzens at risk for being "disappeared". American democracy has never been so close to disappearing. We urgently need to contact our Representatives and let them know that we will not stand for the Republicans' fascist takeover of the American government.
